1. PURPOSE OF DISCLAIMER

This disclaimer aims to specify the nature of services offered by Soluax.ai, the limitations of liability applicable to AI-generated content, as well as user obligations regarding the use of Digital personas, fictional content and representations of real persons.

2. NATURE OF GENERATED CONTENT

The Services offered by Soluax.ai are based on artificial intelligence technologies allowing automated generation of content, including:

  • images,
  • videos,
  • voice,
  • virtual Digital personas,
  • UGC-type content.

Generated content is by nature artificial, synthetic and automated. They do not constitute in any way faithful, accurate or guaranteed representations of reality.

3. FICTIONAL CONTENT AND DIGITAL PERSONAS

Unless otherwise explicitly stated, Digital personas and content generated via the Soluax.ai platform are considered fictional.

Any resemblance to an existing or deceased real person would be coincidental, except voluntary use by the user in accordance with the provisions set out below.

4. REAL PERSONS – DEEPFAKE

The generation, transformation or distribution of content representing an identifiable real person is only authorized if the user has obtained written, prior, explicit and valid consent from the person concerned.

The user expressly acknowledges that:

  • they are solely responsible for obtaining this consent,
  • they must keep this document,
  • they undertake to be able to produce it in case of complaint, dispute, report or inspection by a competent authority.

Soluax.ai is not required to verify the existence, validity or scope of this consent and disclaims all responsibility in this regard.

5. PROHIBITED USES

It is strictly forbidden to use Soluax.ai Services to:

  • violate the image rights, privacy or reputation of a person,
  • generate deepfakes without written consent,
  • produce misleading, false content or likely to mislead the public,
  • impersonate a real person,
  • generate illegal, defamatory, hateful content or contrary to public order,
  • produce or distribute content involving minors.

6. USER LIABILITY

The user acknowledges using the Services under their sole and entire responsibility.

They are solely responsible for:

  • the content they generate,
  • its use,
  • its distribution,
  • its compliance with applicable laws and regulations.

The user guarantees Soluax.ai against any claim, action, demand or proceeding from a third party related to the use of the Services or generated content.

7. LIMITATION OF SOLUAX.AI LIABILITY

Soluax.ai acts exclusively as a technical service provider.

Soluax.ai cannot be held responsible:

  • for the use made by the user of generated content,
  • for the interpretation or distribution of this content,
  • for direct or indirect damages resulting from its use.

8. REPORTING AND MEASURES

Soluax.ai reserves the right, without notice, to suspend or delete any content or user account in case of report, reasonable doubt or violation of the General Terms and Conditions or this disclaimer.

9. ACCEPTANCE

Use of Soluax.ai Services implies full and complete acceptance of this disclaimer, in addition to the General Terms and Conditions of Use and Sale.
